Terms and Conditions

By joining the BT Performance Tennis team, you agree that you are providing consent for all students listed to participate voluntarily in the tennis lessons conducted by BT Performance Tennis. And may be allowed to be posted on the BT Performance Website, Facebook, and Instagram page. Any offer of free lessons must be completed in a group class. No private sessions will be conducted for free.

To the best of your knowledge and belief, the Participant is currently healthy and will let the tennis coaches know of any injuries or medical conditions that may prevent the Participant from participating fully in a tennis lesson.

You recognise that the activities the participant will be involved in are energetic and physically demanding and may involve an element of risk (e.g. running, jumping). In the event of an accident, you request that the instructors secure emergency services to provide aid if in their judgment such services are necessary. You agree to incur any additional expenses associated with such action. You have decided (with or without medical advice) that the participant is physically, socially, and mentally able to participate, and acknowledge that any medical or accident insurance you consider necessary will be your responsibility to locate and purchase.

Furthermore, you have read and agree to the terms of these policies, and do hereby release BT Performance Tennis and its employees from liability for any damages, injuries, or losses, which may occur while the Participant is participating in tennis lessons with BT Performance Tennis.

Terms and Conditions Extended

1. Registration and Enrolment

1.1 Prior to the commencement of any class or tennis coaching service provided by BT Performance Tennis, all clients must complete the registration process, which includes providing accurate and up-to-date contact information.

2. Payment and Refunds

2.1 All fees for BT Performance Tennis classes and services must be made in advance of the scheduled session (unless directed differently, eg. Our direct debit system). Payment options and schedules will be communicated to you upon registration.

2.2 Refunds for Group classes will only be processed if a cancellation notification is received at least 1 hour before the scheduled class or session. Refunds will be issued using the original method of payment and may be subject to processing fees.

3. Health and Fitness

3.1 BT Performance Tennis classes and coaching services are designed to provide a high-intensity workout. By participating in our lessons, you acknowledge that you are in adequate physical condition to partake in such activities.

3.2 It is your responsibility to assess your own fitness level and health condition before participating in any BT Performance Tennis class or coaching session.

3.3 If you have any pre-existing health conditions or concerns that may be affected by the physical demands of our classes, you must inform us in advance of your participation. It is crucial that you disclose any relevant medical information, including but not limited to allergies, injuries, medical conditions, or other factors that may impact your ability to participate safely.

3.4 You acknowledge and understand that any health-related issues, injuries, or illnesses that may arise as a result of participating in BT Performance Tennis classes are not the responsibility of BT Performance Tennis, its instructors, or staff. You participate at your own risk, and you release BT Performance Tennis from any liability for such issues.

4. Liability and Waiver

4.1 By enrolling in BT Performance Tennis classes or coaching services, you acknowledge and accept the inherent risks associated with physical activity, including the risk of injury. You release BT Performance Tennis, its instructors, and staff from any liability for injuries, illnesses, or other adverse health effects that may result from your participation in our classes.

4.2 You are encouraged to consult with a healthcare professional before beginning any new fitness program, especially if you have pre-existing health conditions or concerns.

Please carefully review these terms and ensure that you are comfortable with the acknowledgment and waiver of liability before participating in BT Performance Tennis classes or coaching services.

5. Class Schedule and Changes

5.1 BT Performance Tennis reserves the right to modify class schedules, locations, or instructors as needed. We will make reasonable efforts to notify you of any changes in advance.

 6. Code of Conduct

6.1 You are expected to conduct yourself in a respectful and sportsmanlike manner during all BT Performance Tennis classes and sessions.

6.2 Any disruptive or inappropriate behaviour may result in your removal from the class or session without a refund.

 7. Photography and Promotion

7.1 BT Performance Tennis may occasionally take photographs or videos during classes or coaching sessions for promotional purposes. By participating, you grant us permission to use your likeness for such purposes.

 8. Social Media

8.1 By signing up and accepting these Terms and Conditions, you consent to BT Performance Tennis using pictures and videos of you in our classes or coaching sessions for promotional and marketing purposes on our official social media platforms, website, and other marketing materials.

8.2 If you do not wish to have your images or videos used for promotional purposes, please inform us in writing via email at info@btpt.com.au. We will make reasonable efforts to accommodate your request.

 9. Contact Information

9.1 It is your responsibility to keep your contact information up-to-date with BT Performance Tennis for effective communication regarding class schedules, changes, and other important information.

 10. Governing Law

10.1 These Terms and Conditions are governed by the laws of Victoria. Any disputes arising from or related to these terms shall be resolved in the courts of Victoria.

 11. Agreement

11.1 By enrolling in BT Performance Tennis classes or coaching services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. Failure to comply with these terms may result in your exclusion from BT Performance Tennis activities.

Please carefully review these Terms and Conditions before registering for any BT Performance Tennis class or coaching service. If you have any questions or concerns, please contact us for clarification. Your participation in our classes signifies your acceptance of these terms.

 

DIRECT DEBIT

Terms and Conditions

By providing your payment method details to us (BTPT) you accept and understand that these terms and conditions (Terms and Conditions) apply to your requested and authorised payment arrangement (Direct Debit arrangement) and you authorise your financial institution or any other payment service provider and to arrange for funds to be debited from your relevant account in payment of amounts you owe to BTPT from time to time (unless and until you cancel your Direct Debit arrangement). BTPT is authorised to use your Direct Debit arrangement in accordance with these Terms and Conditions.

You should contact your financial institution or any other payment service provider if you are uncertain about providing your payment authority to us.

Terms and Conditions

  1. BTPT is authorised to use your nominated payment method to arrange the payment of amounts due and payable to BTPT by you until your Direct Debit arrangement is cancelled or terminated in accordance with these Terms and Conditions.

  2. Your authorised payment method details will be securely stored by BTPT, and may be used by BTPT, in accordance with the BTPT Stored Payment Method Terms and Conditions.

  3. If your Direct Debit arrangement relies on a credit card or debit card, it can only be a Visa or MasterCard credit card or debit card (as applicable) and you authorise BTPT to request payment from your nominated card account, using your current card and any replacement or substitute of that card from time to time. If your credit card or debit card has reached its expiry date, you should still provide BTPT with your new details at least three business days prior to the next payment due date.

  4. Bank transaction fees and Government taxes may apply.

  5. Payment obligations falling on a non-business day will be processed using your Direct Debit arrangement on the next business day. If you are uncertain as to when a debit will be processed by your financial institution or any other payment service provider, you may contact them directly.

  6. If your BTPT account has an overdue amount prior to your Direct Debit arrangement commencing, you authorise us to debit this amount using your Direct Debit arrangement.

  7. If sufficient funds are not available in your nominated payment method account at the time of processing a payment, a dishonour fee may be charged by both your financial institution or any other payment service provider and BTPT to cover reasonable administrative and processing costs. It is your responsibility to ensure that you have sufficient funds available in your nominated payment method account by the due date for the payment of any bill payable to BTPT.

  8. BTPT may terminate your Direct Debit arrangement if 2 consecutive payments are refused by your financial institution or any other payment service provider. You must then pay your bills using another payment method available to you and accepted by BTPT.

  9. If you wish to change your Direct Debit arrangement (including your payment details), you must provide BTPT with a new Direct Debit arrangement at least 3 business days prior to when the next bill is due to be paid.

  10. To cancel or terminate your Direct Debit arrangement you must notify BTPT, your financial institution or any other payment service provider, at least 3 business days prior to when your next payment is due. If you cancel your Direct Debit arrangement, or a debit item, by notifying your financial institution or any other payment service provider, you must use your best endeavours to notify BTPT as soon as practicable after the cancellation.

  11. If you request us to cancel your Direct Debit arrangement and do not provide us with a new Direct Debit arrangement, we will terminate your Direct Debit arrangement within 3 business days of being notified of your cancellation request.

  12. If you are leaving BTPT, a final bill will be sent to you and the amount due will be debited using your Direct Debit arrangement.

  13. BTPT may vary these Terms and Conditions at any time on not less than 14 days’ notice.

  14. BTPT reserves the right, at any time, to withdraw this payment arrangement or stop or change a Direct Debit arrangement with 14 days' prior notice. In the event that BTPT ceases to trade, all Direct Debit arrangements will be cancelled immediately and both you and your financial institution or payment service provider will be notified.

  15. Contact BTPT via email (info@btpt.com.au) or by phone (0478 052 932) for assistance or if you have a dispute about any payment or arrangement details. We will investigate the dispute and provide our response within 20 business days. You may also raise your dispute with your financial institution or any other payment service provider.

 

Privacy

  1. The personal information collected by BTPT under these Terms and Conditions is required to set up your Direct Debit arrangement. Failure to provide the information will mean BTPT is unable to complete your request to set up your Direct Debit arrangement.

  2. Details of your Direct Debit arrangement, including your Direct Debit arrangement details (which are tokenised in the case of credit and debit cards), may be used in connection with your payment for products and services that BTPT makes available to you.

  3. Your personal information will be handled in accordance with BTPT Privacy Policy or otherwise as required or authorised by law, or as consented to by you. All Direct Debit arrangement details will be held securely by BTPT and handled in accordance with BTPT’s Privacy Policy.

 

BTPT Stored Payment Method Terms and Conditions.

1. Interpretation

1.1 General

  1. You agree and acknowledge that BTPT may collect, use and disclose the Payment Methods (defined below) which you provide to BTPT in accordance with these terms and conditions (Terms and Conditions). 

2. Payment methods

2.1 Collection of details

  1. BTPT collects payment details (including, but not limited to, the details of any bank account, credit card, debit card or email address associated with any payment account) (Payment Methods) from you when you make a payment to BTPT or request a refund using an BTPT accepted payment option (including by phone, online, PayPal, under an SMS Pay arrangement or Direct Debit arrangement or such other payment option approved by BTPT from time to time) (Payment Option).

  2. You agree that any Payment Method you provide to BTPT will be available to BTPT to use in accordance with your authorisation and clause 5 (Privacy) below.

2.2 Secure storage of Payment Methods

  1. The relevant Payment Method (which is tokenised in the case of credit and debit card details) and the Payment Option (including any standing authority) used to make a payment to BTPT are stored by BTPT (Stored Payment Methods).

  2. All Stored Payment Methods will be held securely by BTPT and, if required, stored by BTPT in accordance with Payment Card Industry Data Security Standard (PCI DSS) information security standard requirements and otherwise as required by law.

2.3 Usage of Stored Payment Methods

  1. Stored Payment Methods can be used by BTPT and you to make any payments to BTPT for BTPT services using any Payment Option authorised by you. No payment will be processed without your authorisation.

  2. BTPT will continue to use your Stored Payment Methods for payments authorised by you until you advise us of any change to those Stored Payment Methods or your payment arrangement with BTPT is terminated in accordance with the relevant terms and conditions that apply.

  3. If your payment method is a credit card or debit card, you authorise BTPT to request payment from your nominated card account, using your current card and any replacement or substitute of that card from time to time. If your credit card or debit card has reached its expiry date, you should provide BTPT with your new details at least three business days prior to the next payment.

  4. BTPT reserves the right to charge a payment processing fee for the use of a particular Payment Option. Bank transaction fees and Government taxes may also apply.

  5. Any credit or refund made to you by BTPT may be refunded using your Stored Payment Methods.

  6. Your Stored Payment Methods, including details of your current Payment Options, may also be used in connection with any BTPT services that we provide to you.

2.4 Disclosure of Stored Payment Methods

  1. Stored Payment Methods used to make a payment, credit or refund will be disclosed by BTPT to relevant financial institutions and payment service providers for the purposes of:

    1. facilitating that payment, credit or refund; and

    2. complying with PCI DSS information security standard requirements.

  2. Stored Payment Methods may be disclosed to people and organisations that help BTPT with our business, such as payment service providers, professional advisors, IT support, and corporate and administrative services including mercantile agents (including debt collectors) and debt buyers. We only do this where it is necessary to disclose that information in order for those services to be provided to BTPT.

  3. Stored Payment Methods may also be disclosed by BTPT to comply with any applicable provisions of any legislation, including without limitation, any privacy legislation.

2.5 Verification of Payment Methods

  1. When requested by BTPT, you agree to provide to BTPT information, including but not limited to, certified identification documents, bank statements and other documents in order for BTPT to:

    1. verify (or further verify) your identity;

    2. verify information in connection with a bank account used to make a payment;

    3. verify information in connection with a non-bank account Payment Option used to make a payment; and

    4. verify where any payment to BTPT originated.

  2. BTPT may confirm directly with the financial institutions and payment service providers that supplied the Payment Option used by you to make a payment, that the Payment Method provided by you are valid and correct.

  3. Until BTPT is satisfied that the verification information provided above is true, accurate and complete, BTPT reserves the right to refuse any payments, and refund any payment at its discretion should it deem any payment to be (or likely to be) unauthorised or made by a person other than you.

  4. BTPT may refuse to accept a payment made using any Payment Option in its absolute discretion including, but not limited to, circumstances where the relevant Payment Option has been dishonoured in connection with a previous payment.

 

3. Managing BTPT stored payment method

3.1 Adding new Payment Methods

If you wish to add new Payment Methods which have not yet been used to make a payment and are not currently stored by BTPT, you can provide new Payment Methods to BTPT by contacting our Customer Service team via email (info@btpt.com.au) at any time.

3.2 Changing or removing Stored Payment Methods

  1. You may change or remove any of your Stored Payment Methods at any time.

  2. If you wish to change or remove any of your Stored Payment Methods you must notify BTPT by contacting our Customer Service team via email or phone call at any time

  3. Any future payments that are yet to be processed using your Stored Payment Method may be cancelled upon the removal of the Stored Payment Method.

 

4. Changes to Terms and Conditions 

BTPT may vary these Terms and Conditions at any time. If BTPT varies these Terms and Conditions, BTPT will provide you with written notice of the change as soon as practicable, which may be after the variation takes effect, and in any event, no later than on your next bill.

5. Privacy

1.    The information about the collection, use and disclosure of personal information (including Payment Methods) in this clause 5 should be read in conjunction with BTPT Privacy Policy, which is incorporated into these Terms and Conditions and contains more detailed information about how your personal information is processed.

2.    You consent to BTPT collecting and handling your personal information (including Payment Methods) in accordance with BTPT Privacy Policy or otherwise as authorised or required by law, or as consented to by you.

Details of your personal information, including Payment Methods (which is tokenised in the case of credit and debit cards), may also be used/disclosed by BTPT in connection with the payment of any products and services that BTPT makes available to you.

1. About us

This policy describes how BT Performance Tennis (BTPT) handle your personal information and credit-related information.

BTPT is a coaching service provider that provides tennis lessons to people in the Carlton north area.

2. Your privacy is important to us

We keep your information safe. We aim to be clear and open about what we do with it.

We understand that your privacy is important to you, and we value your trust. That’s why we protect your information and aim to be clear and open about what we do with it. 

Personal Information has the meaning given in the Privacy Act 1988 (Cth) and includes information or an opinion that identifies you or from which you can be reasonably identified.  

Sensitive Information has the meaning given in the Privacy Act and includes information or an opinion about your racial or ethnic origin, political opinions or associations, religious beliefs or affiliations, philosophical beliefs, professional or trade association or union membership, sexual orientation or practices, criminal records, health information, genetic information and biometric information and templates.

When we collect this information, we follow the obligations set out in the Privacy Act and the Privacy (Credit Reporting) Code 2014.

We update our privacy policy when our practices change. You can always find the most up-to-date version on our website.

3. What information do we collect?

We collect information about you when you interact with us.

We only collect your personal information when BTPT member needs it to provide our services or to comply with the law. The kinds of information that we collect depends on how you interact with us and which services we provide you, with the purposes for collecting the information set out in section 4 of this policy. Here are some examples.

Information we collect from you

We collect the name and contact details (landline, mobile, email) of BTPT customers. We may also collect:

  • If you are a customer: your date of birth, address (supply and mailing if different), address history (where relevant), concession details (where applicable), other forms of identification (such as driver’s licence or passport), payment details, ABN (if applicable), and information about your interactions and transactions with us.

We collect information when you interact with us using the channels we make available to you, including online, through our website, direct contact with our contact number, and social media.

If you give us personal information about other people, we will assume that they have agreed that you can do this. 

Sensitive information

The Privacy Act protects your sensitive information. Where we need this information for your account (for example, to ensure continuous service to your property or to assist with translation services), we will seek your consent before we collect and use sensitive information about you unless we are permitted or required to do so by law.

In some cases, sensitive information (such as information about your proof of vaccination, vaccination status, medical information or medical exemption information) may be requested as part of your role with us. We will collect this information with your permission or where you are required by law to provide it to us. However, we will continue to treat your information in accordance with our obligations under applicable laws (such as the Fair Work Act 2009 (Cth)) and our policy for the management of employee records. 

4. How do we use your information?

We use your information to deliver our services, manage our business and comply with the law. We also use your information for other reasons, such as to better understand you and your needs.

We collect and use your information, so we can:

  • confirm your identity;

  • provide you with the services that you or the organisation you represent have asked for or authorised us to organise on your behalf, including customer support;

  • handle payments and refunds;

  • communicate with you about your account

  • manage your credit arrangements with us

  • manage accounts that are overdue

  • respond to applications, questions, requests or complaints that you have made to us;

  • maintain and update our records and carry out other administrative tasks;

  • research the usage of, and to develop and improve the capabilities of our services, as well as developing new services;

  • improve customer experience and do market research;

  • investigate possible fraud and illegal activity;

  • comply with laws;

  • assist government agencies and law enforcement investigations;

  • manage our business and assets, including any restructure, merger or sale of our business or assets or any part of them;

5. Who do we share your information with?

We share your information for the purposes set out in section 4, with our service providers, and to comply with the law. When we do this, we take steps to keep your information safe.

We share your personal information with other people and organisations where we need to for the purposes set out in section 4. This includes sharing:

  • with other members of the BTPT team, to carry out any of the purposes set out in section 4;

  • with other third party service providers, so they can make debits and you can maintain services that we offer;

  • with marketing and analytics organisations, for relevant purposes such as those set out in section 4;

  • with credit reporting agencies to process new applications, assess and manage applications for credit, manage overdue accounts, and review your creditworthiness;

  • with people that you have asked us to provide your information to, such as your authorised representatives or legal advisors, accredited data recipients or other data holders under the CDR regime (where applicable);

  • to comply with laws and assist government and law enforcement agencies.

We also share personal information with people and organisations that help us with our business, such as professional advisors, IT support, and corporate and administrative services including mercantile agents (including debt collectors) and debt buyers. We only do this where it is needed for those services to be provided to us. When we do this, we take steps that require our service providers to protect your information.

6. Keeping your information safe

We train our staff on how to keep your information safe and secure. We use secure systems and environments to hold your information. We only keep your information for as long as we need it.

We take steps in accordance with the Guide to Securing Personal Information published by the Office of the Australian Information Commissioner, to secure our systems and the personal information we collect.
